It has come our attention that the indemnification provision of the Waiver, Release & indemnification section of our entry form is contrary to US SAILING policy. Hence, Premiere Racing, the organizing authority, waives and will not enforce the indemnification provision.

"...and I do hereby agree to indemnify and hold harmless each of them against any such claims that any officer, member of my crew or one of my guests (or the executors, adminitrators, heirs, next of kin, and assigns of any of them) may have or assert together with any costs and expenses including attorney’s fees with respect thereto."

Notice and Conditions of Race
January 19-23, 2004

Terra Nova Trading Key West 2004 is an international regatta that will provide both individual and team competition. This event will be organized and conducted by Premiere Racing, Inc., which will have the authority to reject or rescind the entry of any boat before the start of the first race. An International Jury will interpret the rules and conditions of the race and decide any protests. The fleet will be divided into divisions and classes at the discretion of the Race Committee. Part I of this Notice deals with general administrative information and Part II with the Rules and Conditions of Race Week.

Any commercial or editorial reference to this event must use the regatta's official name, which is Terra Nova Trading Key West 2004. Any commercial video of the event must be licensed by Premiere Racing.

8 TELEVISION AND PHOTOGRAPHERS' RIGHTS
Competitors give absolute right and permission for video footage or photographs of themselves or their boat to be published in any media for press purposes and editorial or advertising purposes.
